the Overview of the System of Intellectual Property (SIP)

28.08.2015. The delegation of the Organization for Economic Co-operation and Development (OECD) paid a working visit to Kazakhstan from 24th to 28th of August, 2015, in order to prepare the Overview of the System of Intellectual Property (SIP). The event took place within the framework of the project for “Increase of competitiveness by optimizing the innovation policy in Kazakhstan”.

It should be noted that the OECD has already prepared similar overviews for various developing and developed countries.

Preparation of the Overview of the System of Intellectual Property of Kazakhstan was initiated by the request of the RK Government. The objective of the overview is to develop a set of recommendations for the state’s economic growth by making an impact on the efficiency of Kazakhstan’s system of intellectual property. The study will be based on thorough analysis and will include recommendation based on best practices in this sphere. The delegation consisted of Dr. Caroline Paunov (Senior Economist of OECD, Paris, France), Dr. Jose Raymond de Rosse (OECD consultant, assistant professor of Autonomous University of Madrid, Spain), Evgeny Moiseichev (OECD Partnership Center analyst – HSE, National Research University Higher School of Economics (NRU HSE, Moscow, Russia) and Chan Jiao (OECD consultant, Paris, France).

In the course of the working visit OECD representatives met with the representatives of the Science Committee of the MES of RK and Information-Analytic Center JSC. Moreover there were meetings with the employees of MJ of RK, Real Estate Fund “Samruk-Kazyna” JSC, Technology Commercialization Center LLP, Ministry of Investment and Development of RK, National Agency for Technological Development JSC, National Scientific-Technological Holding Parasat JSC, Kazakh Research and Development Institute for Agricultural Products Processing LLP, Atameken RPE, Gumilyov ENU, S. Seifullin Kazakh Agro Technical University, National Center of Science and Technology Evaluation, Supreme Court and Nazarbayev University.

During the meeting a set of questions regarding the project were asked. The OECD experts reviewed the Law on Commercialization and put comments to it. The draft law in the edited version is introduced to the Parliament for consideration.

In particular, at the meeting with the representatives of the Ministry of Justice Caroline Paunov addressed the issue of recommendations to promote economic growth of the country, impacting the efficiency of innovative activities and by improving the intellectual property system. Moreover, the meeting participants were offered the table with suggestions, discussed within the Working Group, on carrying out the systematic work on transition to OECD standards regarding intellectual property protection, as well as the draft law “On trademarks, service marks and names of products origin” in new edition. During the meeting issues regarding the competence of the Ministry of Justice of the Republic of Kazakhstan to register intellectual property objects were also raised.

The Ministry of Justice Chairman Sh. T. Abdreyeva covered the questions concerning national legislation on intellectual property. She also talked about the amendments introduced to Patent Law.

Sh. T. Abdreyeva in her speech mentioned the new economic program Nurly Zhol – The Path to the Future and the program of 5 institutional reforms aimed at modernization of Kazakhstani society and the state, as well as through the rule of law, including strengthening the independence and impartiality of judicial system, provision of state apparatus transparency and its accountability to the civil society, simplifying the access to justice.

On the results of the meetings the OECD experts valued highly the openness and interest in providing objective assessments on improving the system of intellectual property of the RK.
